Huawei said it applied for an invention patent called “a method, device and mobile terminal for adding ICONS in the interface” on April 28, 2010, and was granted the invention patent on December 31, 2014, which is still valid until now.

In this regard, Huizhou Samsung argued that the five mobile phones involved in the case did not use the technical solution described in the patent claims of Huawei, but used existing technology. The patent involved in the case claimed by Huawei is a method patent, and only the use of the patent is protected, while the two defendants did not use the method claimed by the patent involved.

Samsung China’s opinion and Huizhou Samsung basically consistent, that the company did not manufacture infringement. Huawei has no evidence to prove that it sold the phones involved, and the phones sold were legally sourced from Huizhou Samsung.
