By about 2 p.m., Sun called Didi’s customer service to report the situation, and at about 3:30 p.m., she found that the missing money had been returned to her account.

It is understood that the majority of drivers appear or account more money. According to Xu, there is a driver around him who has more than 1,500 yuan in his account. Today, he directly withdrew the extra money and his own operating income. However, he understands that the driver’s account has now been suspended.

According to Xu, even though some drivers around him completed the withdrawal and turned the extra figures into cash in their bank accounts, there were negative numbers in these drivers’ accounts: “For example, this driver earned 500 yuan from work today, but there was an extra 1,000 yuan in his account for no reason. He withdrew $1,500, and his account ended up negative $1,000.”

CAI Xiangnan, a lawyer at Zhejiang Kaiwang Law Firm, said that from a civil point of view, the withdrawal of cash by drivers is an act of unjust enrichment, and Didi can Sue drivers to return some of the extra money. From the perspective of criminal law, on the basis of cash withdrawal, the withdrawal of more than 3,000 yuan does not belong to their own part, if it can be determined that the driver knows or knows that the money does not belong to their business funds, the driver’s behavior may constitute the crime of theft.

He suggested that didi drivers who withdraw cash should cooperate with Didi to return the money that does not belong to them to Didi, or negotiate with Didi on how to handle the money to avoid unnecessary trouble.

Didi’s official response so far:

This afternoon, due to the server upgrade, the balance information of some car owners’ accounts on Didi Car owner app and Didi Chuxing App was abnormal. Currently, the balance consumption functions of car owners in the above app, such as withdrawal of balance, phone fee and refueling, are temporarily closed, while the functions of charging phone fee and refueling on didi’s car owner app by Alipay or wechat Pay are not affected.

Didi will fix the glitch no later than 23 PM on November 3. During the repair period, car owners can still receive orders as usual, and all actual income will not be affected.

But didi did not respond to questions about the treatment of drivers who have already withdrawn cash.
